Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of the WaveSpell website and iOS app (together, the “Service”), operated by WaveSpell (“we,” “us,” or “our”). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility
WaveSpell is not directed to children under 13, and you must meet the minimum age required in your jurisdiction to use online services without parental consent. By using the Service, you confirm you meet this requirement and that any information you provide about yourself is your own to give.
Your account
You need an account to use most of the Service. You are responsible for the accuracy of the information you provide, for keeping your sign-in credentials secure, and for all activity that happens under your account. Tell us promptly at info@wave-spell.com if you suspect unauthorized access.
You can permanently delete your account at any time from Account → Delete Account in the iOS app. Deleting your account does not automatically cancel an active Apple subscription — cancel that separately in your Apple Account subscription settings.
What WaveSpell is — and isn’t
WaveSpell calculates personal, relationship, cycle, and geographic patterns from a deterministic calendrical and astronomical model, based on the birth date, time, and place you provide. These calculations are a tool for reflection, not verified facts about a person.
WaveSpell does not provide medical, psychological, legal, or financial advice, and does not claim certainty about what will happen next. Do not use the Service as a substitute for professional advice, and do not use it, or let anyone else use it, to make decisions about employment, insurance, credit, health, safety, or other consequential matters affecting yourself or another person.
Acceptable use
When using the Service, you agree not to:
- Violate any applicable law, or the rights of any other person;
- Enter another person's birth or personal information into Circle/People without a reasonable basis for believing you may do so;
- Impersonate any person or entity, or misrepresent your affiliation with one;
- Harass, abuse, or attempt to identify, locate, or harm another user from information shared through the Service;
- Reverse-engineer, scrape, or attempt to extract the Service's underlying calculation engine, source code, or non-public data;
- Interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
- Use the Service to build a competing product, or resell access to it, without our written permission.
We may suspend or terminate access for anyone who violates these Terms.
Subscriptions and purchases
WaveSpell+ is offered as an auto-renewing subscription (monthly or annual), purchased and billed through Apple's in-app purchase system. Where offered, a free trial converts to a paid subscription automatically at the end of the trial period unless you cancel before it ends.
Payment is processed by Apple, not by us directly; RevenueCat verifies and reports subscription status on our behalf as described in our Privacy Policy. Your subscription automatically renews for the same term at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period, in your Apple Account subscription settings.
Refunds are handled by Apple under its own policies — we cannot issue refunds directly for App Store purchases. We may change WaveSpell+'s features or pricing prospectively; changes will not retroactively apply to a billing period you have already paid for.
Your content
You retain ownership of the content you create in WaveSpell — reflections, notes, saved WaveSpells, and your public profile. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it as needed to operate and provide the Service to you and, where you choose to publish it, to other users.
When you publish a WaveSpell, its title, description, composition, and author profile become visible to others, and may be remixed by other users within the Service. Unpublishing removes it from active discovery within WaveSpell, but cannot recall copies, screenshots, or remixes already made by other people or cached by third parties.
You are responsible for the content you submit and for having the right to share any information about other people that you include. Do not submit content that is unlawful, infringing, or that you do not have the right to share.
Our intellectual property
The Service, including its design, calculation engine, software, text, and visual identity, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our name, trademarks, or branding without our prior written permission.
Third-party services
The Service relies on third-party providers, including Supabase, Vercel, Apple, RevenueCat, Cloudflare, Open-Meteo, and OpenStreetMap Nominatim, described in our Privacy Policy. We are not responsible for the availability, content, or practices of these third parties, which are governed by their own terms.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CALCULATED INTERPRETATION, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DECISION YOU MAKE BASED ON IT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVESPELL AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably practicable. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
Changes to these terms
We may update these Terms as the Service changes. We will revise the date on this page when we do, and, for material changes, provide additional notice where required. Continuing to use the Service after a change takes effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws applicable to WaveSpell's operator, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute not resolved informally will be brought in a court of competent jurisdiction, subject to any mandatory consumer-protection rights in your jurisdiction.
